Terms and Conditions

Introduction

This Agreement ("Agreement") is a binding contract between VPS Panda (referred to as "We," "Us," or "Our") and the user of VPS Panda's services (referred to as "You," "Your," "Client," or "Customer"). By using VPS Panda's services, You agree to all the terms and conditions outlined in this Agreement. These terms cover key aspects such as service delivery, refund policies, acceptable use, and other critical areas.

Service Activation and Delivery

Once payment is successfully completed, You will receive an automated receipt via email. Please retain this for future reference. A unique customer ID will also be included in the receipt for inquiries and support communication.

VPS Panda strives to deliver services promptly after signup. In the event of any delay, You will be notified via email or phone. Charges are applied only upon service delivery.

All service-related orders are delivered electronically. For order-related questions, please reach out to [email protected].

Our support team operates 24/7, year-round, and typically responds to inquiries within one hour.

Note: Ensure compliance with import/export regulations applicable in your region for our services.

Satisfaction Guarantee and Refund Policy

If You are unsatisfied with any aspect of our services, please contact our support team. We will make every effort to resolve the issue. Should the issue remain unresolved, You may request a refund within 30 days.

Refund exclusions include:

• Domain names (.COM, .NET, .ORG, etc.), SSL certificates, and domain transfer fees.
• VPS and Dedicated servers, except where explicitly stated in our Terms of Use.
• Accounts terminated due to violations of our Acceptable Use Policy.

Additional refund notes:

• Credits added to your account are non-refundable and must be used for future purchases or renewals.
• Setup fees are non-refundable.
• Promotional accounts are not eligible for the 30-day money-back guarantee.

Excess payments to VPS Panda will be converted to account credit and cannot be refunded.

Uptime Commitment (SLA)

VPS Panda guarantees 99.9% uptime for all services. Should uptime fall below this threshold in any calendar month, You may claim one month of free service credit. Claims must be submitted within 7 days of the incident.

Planned maintenance is excluded from SLA calculations. Dedicated servers are not covered under this SLA.

Affiliate Guidelines

Affiliates must use the affiliate links exactly as provided in the client area. Modifying or obscuring affiliate links is prohibited.

Spam or advertising in violation of hosting site policies is not allowed and may result in link deactivation.

Web Hosting and Usage Policies

By using VPS Panda's services, You agree to adhere to the Acceptable Use Policy (AUP) and all Terms outlined herein. Non-compliance may result in account suspension or termination.

Pricing and Payment Policies

Control panels are included at no extra charge. However, any misuse or abuse-related expenses may be billed to You.

Data Backup Responsibilities

While VPS Panda performs routine daily backups, we do not guarantee data recovery. You are responsible for maintaining your own backups. A one-time $50 fee applies for data restoration requests.

For suspended or terminated accounts, backups are retained for 2 days. Restoration fees for such accounts are $50, subject to availability.

Account Suspension and Termination

Violations of these terms may result in suspension or termination of services. Grounds for action include but are not limited to:

• Illegal activities or breaches of applicable laws.
• Hosting adult content or pornography.
• Spamming or email abuse.
• Hosting pirated software or copyrighted material.
• Operating unauthorized server programs.
• Excessive resource usage or bandwidth abuse.
• Misrepresentation or fraudulent activity.

Security Responsibilities

You must take reasonable measures to secure your account. Notify VPS Panda immediately of any unauthorized access or breaches.

Intellectual Property and Content Policy

VPS Panda is not responsible for monitoring or reviewing materials posted or transmitted through its services. Complaints about copyright violations should be reported to [email protected] for prompt investigation.

Liability and Warranty Disclaimer

Your use of VPS Panda’s services is at your sole risk. The services are provided "as is" without warranties of any kind, including but not limited to merchantability or fitness for a particular purpose.

VPS Panda is not liable for any damages, loss of data, or service interruptions arising from the use or inability to use our services.

CPU and Resource Usage Policy

Clients must ensure VPS processes do not cause sustained CPU loads exceeding 0.9 or disrupt host systems. Excessive usage may result in suspension or termination.

VPN and Proxy Restrictions

The use of VPNs or proxies is prohibited unless explicitly permitted in a separate agreement. Violations may result in immediate suspension or termination.

Cancellation and Termination Process

To cancel your service, log in to the client area and submit a "Request Cancellation" form for the relevant service. Immediate cancellations take effect within 1 minute of submission.

Dedicated server cancellations require a 7-day advance notice before the renewal date. Failure to cancel in time may result in additional charges.

Important: It is Your responsibility to cancel PayPal subscriptions.

Governing Law and Dispute Resolution

This Agreement is governed by Bangladeshi and International laws. Any disputes will be resolved through binding arbitration under these legal frameworks.

Amendments

VPS Panda reserves the right to amend these Terms and Policies at any time. Updates will be posted on our website, and continued use of services constitutes acceptance of the revised terms.

Discount Voucher Policy

Vouchers are limited to one per customer and per transaction. Any unused portion of a voucher is forfeited. Vouchers cannot be combined with other offers or applied retroactively.
